Terms of Service

1. Acceptance of Terms

Welcome to Mom Labs! By creating an account or using the Mom Labs website, mobile application, or any related services (collectively, the "Service"), you ("Parent" or "Account Holder") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years of age to create an account. By using the Service, you represent and warrant that you are at least 18 years old.

2. Description of Service

Mom Labs provides an AI-assisted platform that allows parents to create customized, personalized stories for their children. The Service uses information provided by the parent — including a child's first name, age, reading level, and story preferences — to generate tailored story content.

Mom Labs offers two access tiers:

• Free Tier: Access to a limited number of stories per month at no cost.
• Paid Subscription: Unlimited story creation, accessed after a free trial or direct purchase.

3. Account Registration

To use the Service, you must register for an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify Mom Labs immediately of any unauthorized use of your account.

Only one adult parent or legal guardian may be the account holder per account. The account holder is solely responsible for all content created and all activity on the account.

4. Children's Privacy and COPPA Compliance

Mom Labs takes the privacy of children very seriously. We comply with the Children's Online Privacy Protection Act (COPPA) and its implementing regulations.

4.1 Parent as Account Holder

All accounts are held by a parent or legal guardian (the "Account Holder"). Children do not create accounts or interact directly with the Service in ways that would constitute personal data collection without parental consent, as you — the parent — provide all information about your child on their behalf.

4.2 Information Collected About Children

In order to personalize stories, Mom Labs collects the following information about children that you provide:

• First name
• Age
• Reading level
• Story preferences (e.g., themes, characters, settings)

We also automatically collect limited usage data related to your account's activity, such as stories generated, pages read, and time spent, to improve our service and for analytics purposes. This data is associated with the parent account, not with your child directly.

4.4 Parental Rights

As the Account Holder, you have the right to:

• Review the personal information we have collected about your child
• Request deletion of your child's personal information
• Refuse to permit further collection or use of your child's information by deleting your account

5. Subscription, Billing, and Free Trial

Mom Labs offers a free tier that allows you to create a limited number of stories. Once you reach the free story limit, you will be prompted to subscribe to a paid plan to continue creating stories.

5.1 Paid Subscription

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

5.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time in a billing period, except where required by applicable law.

5.3 Price Changes

Mom Labs reserves the right to change subscription pricing. We will provide at least 30 days' advance notice of any price changes via email or in-app notification. Continued use of the Service after the price change takes effect constitutes your acceptance of the new pricing.

6. Intellectual Property

All stories, text, images, audio, and other content generated through the Service ("Generated Content") are the exclusive property of Mom Labs, Inc. By using the Service, you are granted a limited, non-exclusive, non-transferable personal license to access, view, download, and print Generated Content solely for your own personal, non-commercial use.

You may not reproduce, distribute, modify, sell, sublicense, or otherwise exploit Generated Content for any commercial purpose without the prior written consent of Mom Labs.

All trademarks, logos, and service marks displayed on the Service are the property of Mom Labs or their respective third-party owners.

7. User Conduct

You agree not to use the Service to:

• Provide false, inaccurate, or misleading information
• Circumvent any technical measures used to restrict access to the Service
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Share your account credentials with any other person

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MOM LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOM LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MOM LABS'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOM LABS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Wilmington, Delaware, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

11. Changes to These Terms

Mom Labs reserves the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

12. Termination

Mom Labs may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us at momlabsapp@gmail.com. Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.
